1. Scope and provider
1.1 These Terms govern access to the interfaces of theButler.network by software. Today this is the MCP endpoint (Model Context Protocol) through which AI assistants and other programs search our product catalogue (the "Interface").
1.2 They apply to every person and every company that calls the Interface or operates a program that calls it. This includes providers of AI assistants, developers, and users who connect the Interface to an assistant themselves ("you").
1.3 The provider is Sebastian Ott, theButler.network, Lichtel 36, 97993 Creglingen, Deutschland, Germany ("we", "us", "TBN"). Full details in our Legal Notice.
1.4 Our Terms of Use apply in addition. For the use of the Interface these Terms take precedence where they provide otherwise.
1.5 The Interface may only be used under these Terms. A separate written agreement with us takes precedence over them.
2. What the Interface provides
2.1 In response to a request, the Interface returns products, offers, prices, availability and links to retailers from our catalogue. This information comes from data feeds of retailers and partner networks. Section 4 of the Terms of Use applies accordingly: the price and availability at the retailer at the time of purchase are decisive.
2.2 We are not a seller. A purchase contract is concluded exclusively between the buyer and the retailer (Section 2 of the Terms of Use).
2.3 Use is free of charge. There is no right to access, to a particular availability or response time, or to complete results.
2.4 We may change, restrict or discontinue the tools, fields, formats and limits of the Interface at any time.
3. Permitted use
3.1 You may call the Interface on behalf of a specific person for that person's own purpose and show them the result. Such a purpose is, for example, a question, a comparison, a recommendation or a price watch that this person has set up themselves.
3.2 Results may remain part of the conversation with this person and be stored with it. Beyond that, you may cache results only for as long as is technically necessary to answer the request, and for no more than 24 hours.
3.3 Any other use requires a separate written agreement. Please send enquiries to contact@thebutler.network.
4. Presentation of results
When you show results to a person, the following applies to the extent your presentation allows it:
4.1 You pass on links to retailers unchanged. They lead to the retailer through our domain and carry the attribution to us. You may not shorten them, rewrite them, replace them with your own links, or add or remove parameters.
4.2 You show prices together with their age. Every offer carries the time of the most recent feed import that still contained it (field source_imported_at). You may not present a price as current, checked or guaranteed.
4.3 Notices stay in place. If a person buys through a link, the retailer may pay us a commission (Section 7 of the Terms of Use). You do not remove notices about this or about their origin that come with the results.
4.4 You may summarise, shorten and rephrase results. In doing so you may not falsify prices, retailers or availability.
4.5 You do not create the impression that results are test results, your own checks or placements sponsored by us. The amount of our commission influences neither the selection nor the order (Section 5.3 of the Terms of Use).
5. What is not permitted
You do not use the Interface for:
5.1 bulk retrieval, systematic searching or enumeration of the catalogue, or requests that do not originate from the purpose of a specific person;
5.2 building, supplementing or matching your own databases, price histories, indexes or catalogues, or passing on, selling, licensing or publishing results as a dataset;
5.3 training, fine-tuning or otherwise improving artificial intelligence models. The text and data mining reservation in Section 9.3 of the Terms of Use also applies to results of the Interface;
5.4 circumventing limits, in particular through changing addresses, identifiers or programs, or disguising the calling program;
5.5 attacks on availability or integrity, and load tests or security tests without prior agreement with us;
5.6 transmitting personal data that is not needed for the product search;
5.7 using our trademarks beyond naming theButler.network or Edwin as the source;
5.8 unlawful purposes of any kind.
6. Limits and blocking
6.1 We limit requests per sender and in total, for example by frequency, size and effort. We set these limits and may change them at any time. Anyone who exceeds them receives no answer or an error message.
6.2 We may block senders, addresses, networks or programs in whole or in part if they breach these Terms, endanger the security or availability of the service, or if there is a reasonable suspicion of misuse. Because the Interface is used without registration, a prior warning is generally not possible.
6.3 Higher limits are only available under a separate agreement.
7. Data protection
7.1 Which data we process when the Interface is called is set out in Section 3.11 of our Privacy Policy. We do not store the text of a request, only a hash value.
7.2 If you call the Interface for other people, you are yourself responsible for your own processing of their data. We do not process any data on your behalf, and you do not process any on ours.
8. Rights in content
8.1 Section 9 of the Terms of Use also applies to the Interface. In particular, we assert database maker's rights under §§ 87a et seq. of the German Copyright Act.
8.2 Within the scope of Section 3, we grant you a non-exclusive, non-transferable right, revocable at any time, to display results.
8.3 Product images, brand and product names and product descriptions of third parties belong to the respective rights holders. You may display them only together with the result to which they belong.
9. Liability
9.1 Liability is governed by Section 12 of the Terms of Use.
9.2 If you are a business, you indemnify us against third-party claims based on a breach of these Terms for which you are responsible. This includes the reasonable costs of legal defence.
10. Changes and end of use
10.1 The version published on this page at the time of a call applies. Changes apply to calls from their publication onwards.
10.2 You may stop using the Interface at any time. We may prohibit you from using it under Section 6.
11. Governing law, jurisdiction, language
Sections 14 and 15 of the Terms of Use apply accordingly.
12. Contact
